By securing a charter or utilizing our Service, you consent to adhere to these Terms. Should you contest any segment of these terms, you should forego access to the Service.
2. Service Overview
At AmberRiverTrail, we offer luxury sailing charter services, which include but are not limited to:
- Charter rentals for the day
- Evening sailing ventures
- Business getaways
- Exclusive gatherings
- Extended charters across several days
Our services are contingent upon both availability and favorable meteorological conditions. We maintain the right to alter or terminate services without prior notice.
3. Booking and Reservations
3.1 Booking Process
For reservation of a charter, it is required that you:
- Have at least 18 years of age
- Provide precise and complete submission of information
- Remit the necessitated deposit as indicated in your reservation confirmation
- Comply with these Terms & Conditions
3.2 Confirmation
Confirmation of your booking is established upon payment receipt and our issuance of written affirmation. We reserve the authority to reject service to any individual at our discretion.
3.3 Availability
Charter availability is bound by vessel availability and apt weather conditions. We aim to accommodate your desired scheduling to the fullest possible extent.
4. Payment Terms
4.1 Pricing
All pricing is delivered in € and incorporates all relevant taxes unless indicated otherwise. Pricing is subject to modification without prior notification.
4.2 Payment Schedule
- Deposit: A requirement of 50% of total charter cost upon reservation
- Balance: Due no later than 48 hours preceding the charter departure
- Extra charges (if any): Expected upon charter conclusion
4.3 Payment Methods
We accommodate payments via major credit cards, electronic bank transfers, and certified bank cheques. All payment processing utilizes secure, encrypted platforms.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours before departure: Full reimbursement less processing charges
- 24-72 hours prior to departure: Refund of 50%
- Less than 24 hours prior to departure: Non-refundable
5.2 Weather Cancellations
Should the captain deem weather conditions as perilous, we will propose to:
- Reschedule your charter at no extra cost to the next available opportunity
- Issue a full refund when rescheduling proves unfeasible
5.3 Mechanical Issues
In the rare occurrence of mechanical failures with the designated vessel, efforts will be made to provide a comparable alternative. Should an alternative not be procurable, a complete refund will be issued.
6. Safety and Conduct
6.1 Safety Requirements
Passengers are mandated to:
- Heed all instructions given by the crew
- Don safety gear as needed
- Disclose any health conditions that could impinge upon safety
- Stay within specified regions of the vessel
6.2 Prohibited Items
The list below details items disallowed on board:
- Containers made of glass
- Unlawful substances
- Weapons, inclusive of firearms
- Excess non-alcoholic drinks (beyond sensible consumption)
- Animals (except with prior approval)
6.3 Conduct
Passenger behavior ought to be courteous and respectful at all times. Charters may be terminated prematurely without a refund if passenger conduct endangers safety or infringes upon the enjoyment of others.
7. Liability and Insurance
7.1 Our Liability
We hold liability solely to the extent of the charter cost paid. Liability does not extend to:
- Injuries of personal nature attributed to passenger carelessness
- Destruction or loss of personal belongings
- Indirect or punitive damages, or those yielding from consequential losses
- Delays stemming from weather or situations outside our control
7.2 Insurance Coverage
Comprehensive marine insurance is maintained, covering all vessels and operational aspects under our purview. Passengers bear the responsibility for their own personal and travel insurance.
7.3 Assumption of Risk
Engaging in our charter services signifies acknowledgment of the inherent risks present in marine activities and the assumption of responsibility for personal safety.
8. Modifications and Itinerary Changes
Itinerary changes and modifications to routes or schedules may occur due to conditions like weather or safety considerations, or due to operational necessity. We commit to making every effort to offer similar alternative experiences when changes are made.
9. Force Majeure
Events and circumstances falling outside our control, such as but not limited to the following, exempt us from liability for delays, cancellations, or modifications:
- Severe meteorological challenges
- Catastrophic natural events
- Regulatory mandates from governmental entities
- Port closures
- Mechanical breakdowns
10. Privacy and Data Protection
We handle your private details in strict compliance with our Privacy Policy. Utilization of our services constitutes agreement to our collection and use of your data as outlined in the said policy.
11. Intellectual Property
All material present on our website, including but not limited to text, visual elements, trademarks, and logos, is under copyright and trademark protection. Unauthorized replication, distribution, or derivation is not permitted without our express permission.
12. Governing Law
